Article 1 β Definitions and Purpose
Liveriliya is a digital platform connecting senders (businesses or individuals) with independent delivery drivers, operating in Morocco.
These Terms and Conditions (hereinafter "Terms") govern access to and use of the Liveriliya platform available at liveriliya.com and its associated applications.
Definitions:
- "Platform": the website liveriliya.com and any associated mobile application.
- "Sender": any user registered as a business (e-commerce merchant) or individual wishing to send packages.
- "Driver": any independent service provider registered on the platform to carry out deliveries.
- "Recipient": the natural or legal person to whom the package is delivered.
- "Package": any object, merchandise, or document entrusted to the Driver via the Platform.
Article 2 β Registration and User Account
Using the platform requires creating an account. The user agrees to provide accurate, complete, and up-to-date information.
2.1 Account Types
- Business Account (Merchant): for e-commerce professionals wishing to ship packages to their customers.
- Individual Account: for individuals wishing to send packages occasionally.
- Driver Account: for independent service providers wishing to make deliveries. Driver registration is subject to document verification (national ID, driver's license, vehicle registration) within 24 hours.
2.2 Account Security
The user is solely responsible for the confidentiality of their login credentials. Any activity carried out from their account is presumed to have been performed by them. In case of unauthorized access, the user must inform Liveriliya immediately.
2.3 Accuracy of Information
Any false, incomplete, or fraudulent information may result in immediate account suspension, without prior notice or compensation.
Article 3 β Role of Liveriliya
β οΈ Liveriliya acts exclusively as a technical intermediary connecting Senders and Drivers. Liveriliya is neither a carrier, nor a transport agent, nor a party to the delivery contract between the Sender and the Driver.
As such, Liveriliya:
- Provides a technology platform enabling delivery management, tracking, and optimization.
- Provides real-time tracking tools (GPS, SMS/WhatsApp notifications).
- Enables direct connection between Senders and Drivers.
- Does not intervene in the physical execution of deliveries.
- Does not inspect the contents of shipped packages.
Article 4 β Sender Obligations
4.1 Business (E-commerce Merchant)
The professional Sender agrees to:
- Provide accurate information about the package (declared content, weight, dimensions, pickup and delivery address).
- Properly package goods to ensure their protection during transport.
- Only entrust lawful goods in compliance with applicable Moroccan legislation.
- Respect order preparation deadlines and be available for pickup.
- Inform the Driver of any special characteristics of the package (fragile, perishable, heavy, etc.).
- Respect the terms of the subscribed plan and the limits of the pricing plan.
- Assume full responsibility for the content of their packages.
4.2 Individual
The Individual agrees to the same obligations as the Business, and additionally to:
- Use the platform for personal and not abusively recurring commercial shipments.
- Not use false identities.
- Personally assume all consequences related to the content of sent packages.
Article 5 β Driver Obligations
The Driver, as an independent contractor, agrees to:
- Provide valid identity and vehicle documents during registration.
- Collect and deliver packages within the agreed timeframes with the Sender.
- Handle packages with care and diligence throughout transport.
- Comply with traffic laws and applicable regulations in Morocco.
- Maintain their vehicle in good working condition and have valid insurance.
- Not open, inspect, or modify the contents of packages.
- Confirm delivery or report any incident via the platform.
- Deliver the package only to the designated recipient or an authorized person.
- Maintain professional and courteous behavior toward Senders and Recipients.
- Remit collected amounts (cash on delivery) to the recipient or Sender without delay.
β οΈ The Driver operates as an independent contractor. There is no employment relationship between the Driver and Liveriliya. The Driver is responsible for their own tax and social obligations.
Article 6 β Prohibited Products
π« It is strictly forbidden to use the Liveriliya platform for shipping the following products:
- Narcotics, psychotropic substances, and drugs of any kind.
- Firearms, bladed weapons, ammunition, and explosives.
- Counterfeit products or those infringing intellectual property rights.
- Hazardous, flammable, corrosive, radioactive, or toxic materials.
- Protected animal species or derived products.
- Human organs, biological tissues, or bodily substances.
- Currency, bearer securities, or undeclared valuables.
- Any product whose sale, possession, or transport is prohibited by Moroccan law.
- Pornographic content or content contrary to public morals.
- Medications without a valid prescription or unauthorized pharmaceutical products.
In case of violation: the Sender assumes full criminal and civil liability. Liveriliya reserves the right to immediately suspend the account, report the facts to competent authorities, and claim damages.
Article 7 β Liability and Limitations
β οΈ As Liveriliya is a technical intermediary, its liability is strictly limited to providing the platform.
7.1 Liveriliya Disclaimer
Liveriliya shall not be held liable for:
- Theft, loss, deterioration, or damage to goods during transport.
- Delivery delays attributable to the Driver, the Sender, or external circumstances (weather, strikes, force majeure).
- The contents of packages shipped via the platform.
- Commercial disputes between the Sender and the Recipient (returns, refunds, product quality).
- Bodily harm caused by the Driver to third parties or themselves during delivery.
- Non-compliance of shipped products with applicable regulations.
- Indirect financial losses, lost profits, or moral damages.
7.2 Sender Liability
The Sender is solely responsible for:
- The contents of their packages and their legal compliance.
- Adequate packaging of goods.
- Accurate declaration of package contents and value.
- Any consequences resulting from shipping illicit or prohibited products.
7.3 Driver Liability
The Driver is responsible for:
- Packages entrusted to them, from pickup to delivery to the recipient.
- Any damage caused to the package through negligence, carelessness, or failure to exercise due care.
- Compliance with traffic laws and road safety conditions.
- Full remittance of amounts collected on cash-on-delivery orders.
7.4 Dispute Resolution Between Users
In case of dispute between the Sender and the Driver (damaged package, theft, delay, etc.), the parties are invited to resolve the matter directly between themselves. Liveriliya may, at its sole discretion, facilitate communication between the parties but assumes no obligation of mediation or compensation.
Article 8 β Pricing and Payments
8.1 Sender Subscriptions
Senders (Businesses and Individuals) access the platform via monthly or annual pricing plans. Each plan defines:
- The number of packages allowed per month.
- The number of employees who can access the dashboard.
- Available features (notifications, reports, API, etc.).
A free plan is available with limited features.
8.2 Drivers
Registration and use of the platform by Drivers is completely free. No subscription or commission is charged by Liveriliya on Driver earnings.
8.3 Delivery Rates
Delivery rates are freely set between the Sender and the Driver. Liveriliya does not impose a rate schedule but may display indicative rates.
8.4 Cash on Delivery
When a delivery is made on a cash-on-delivery (COD) basis, the Driver collects the amount from the Recipient and must remit it to the Sender according to agreed terms. Liveriliya does not manage financial flows between parties.
Article 9 β Personal Data
Liveriliya collects and processes personal data necessary for the operation of the platform, in accordance with Moroccan Law No. 09-08 on the protection of individuals with regard to the processing of personal data.
Data Collected:
- Full name, username, phone number.
- Identity documents (for Drivers: national ID, driver's license, vehicle registration).
- Geolocation data during deliveries (GPS).
- Delivery and transaction history.
Data Usage:
- Providing and improving platform services.
- Driver identity verification.
- Real-time delivery tracking.
- Communication with users (SMS, WhatsApp, notifications).
- Anonymized statistics for service improvement.
Liveriliya does not sell or share personal data with third parties for commercial purposes. Users may request deletion of their data by contacting contact@liveriliya.com.
Article 10 β Suspension and Termination
10.1 By the User
Any user may request account deletion at any time by contacting support at contact@liveriliya.com. Ongoing deliveries must be finalized before actual closure.
10.2 By Liveriliya
Liveriliya reserves the right to suspend or delete an account, without prior notice or refund, in case of:
- Violation of these Terms.
- Fraudulent use of the platform.
- Shipping of prohibited products.
- Abusive, threatening, or disrespectful behavior toward other users.
- Non-payment of subscriptions for Senders.
- Misappropriation of cash-on-delivery funds (for Drivers).
- Provision of false identity documents.
- Any activity harming the platform's reputation or proper functioning.
Article 11 β Intellectual Property
All elements of the platform (logo, brand, design, source code, texts, images) are the exclusive property of Liveriliya or its partners and are protected by Moroccan and international intellectual property laws.
Any unauthorized reproduction, modification, distribution, or exploitation is strictly prohibited and may be subject to legal proceedings.
Article 12 β Applicable Law and Disputes
These Terms are governed by Moroccan law. In case of dispute relating to the interpretation or execution of these Terms, and failing amicable resolution, the competent courts of Casablanca, Morocco shall have exclusive jurisdiction.
The parties agree to attempt amicable resolution before any legal action, by contacting Liveriliya at contact@liveriliya.com.
Article 13 β Changes to Terms
Liveriliya reserves the right to modify these Terms at any time. Users will be notified of changes via platform notification or any other appropriate means.
Continued use of the platform after notification constitutes acceptance of the new conditions. In case of disagreement, the user may stop using the platform and request account deletion.
